Prosecution of Fly Posting

"Signs advertising 'used and scrap cars wanted' are regularly posted on just about every traffic light in the Elmbridge area. Surrey County Council remove these as regularly. What is the cost to the Council Tax payer and why are Surrey County Council reluctant to prosecute the offender? This king of lenient attitude only fuels encouragement."

Councils have been given new powers to prosecute offenders. Whether they choose to use them is up to the councils enforcement teams.

In reality we have seen at first hand the effectiveness of a friendly telephone call from a council enforcement officer pointing out the problem and the law to the advertiser, followed by a firmer letter if required. This approach usually works and is very cost effective. Of course, prosecution needs to be considered and pursued for the persistent offender.
